Service Agreement

• Booking Confirmation: Services are confirmed upon receipt of full payment and signed agreement
• Service Scope: Services include photography session, editing, and delivery of final images as specified in your package
• Session Duration: Standard sessions are 1-2 hours unless otherwise specified in your package
• Location: Sessions are conducted at agreed-upon locations within our service area
• Weather Contingency: Outdoor sessions may be rescheduled due to inclement weather at no additional cost
• Equipment: We provide all necessary photography equipment and backup gear

Photo Usage Rights and Consent

Granted Rights to Memory Ministry

• Portfolio Display: Use of your photographs on our website, social media, and marketing materials
• Business Promotion: Use in advertisements, brochures, business cards, and promotional content
• Social Media: Sharing on Instagram, Facebook, Pinterest, and other social platforms
• Print Materials: Use in physical marketing materials, displays, and exhibitions
• Third-Party Platforms: Display on photography platforms, directories, and review sites
• Educational Purposes: Use in workshops, tutorials, and educational content

Your Rights and Restrictions

• Personal Use: You may use your photographs for personal purposes (social media, printing, sharing with family)
• Commercial Use: Commercial use of your photographs requires written permission from Memory Ministry, a brand of Alokek Inc.
• Attribution: When sharing online, please credit "Memory Ministry" when possible

Consent Withdrawal

• Written Notice: You may withdraw consent for future use by providing written notice
• Existing Use: Withdrawal does not affect photographs already in use or published
• Reasonable Time: We will remove photographs from new materials within 30 days of withdrawal
• Archived Content: Previously published content may remain in archives and historical materials

Client Responsibilities

• Timeliness: Arrive on time for your session; late arrival may reduce session time
• Preparation: Come prepared with appropriate clothing, props, and any special requests
• Cooperation: Follow photographer's direction and guidance during the session
• Location Access: Ensure we have proper access to the chosen location
• Weather Awareness: Check weather forecasts and be prepared for outdoor sessions
• Payment: Complete payment as specified in your booking agreement
• Communication: Provide timely responses to emails and requests for information

Payment Terms

• Full Payment: Full payment is required to confirm your booking
• Payment Methods: We accept credit cards, bank transfers, and other specified methods
• Late Payments: Late payments may result in session cancellation or additional fees
• Refunds: Refund policies are outlined in our Refund Policy
• Additional Services: Any additional services requested will be charged separately
• Taxes: All prices are subject to applicable taxes

Delivery and Timeline

• Editing Time: Standard editing takes 3-7 business days
• Rush Delivery: Rush editing available for additional fee (2-3 business days)
• Delivery Method: Images are delivered digitally online
• Download Period: Images remain available for download for 30 days
• Backup Storage: We maintain backups of your images for 6 months
• Re-editing: Re-editing requests are not included; changes may incur additional fees

Cancellation and Rescheduling

Our cancellation and rescheduling policies are detailed in our Cancellation Policy. Key points include:

• 24-Hour Notice: Free cancellation/rescheduling with 24+ hours notice
• Late Cancellation: 50% fee for cancellations with less than 24 hours notice
• No-Show: 100% fee for missed sessions without prior notice
• Weather Cancellations: Free rescheduling for weather-related issues
• Emergency Situations: Special consideration for medical emergencies and family crises

Intellectual Property Rights

• Photographer's Rights: Memory Ministry, a brand of Alokek Inc., retains copyright to all photographs
• Client License: Clients receive a limited license for personal use of their photographs
• Commercial Use: Commercial use requires separate licensing agreement with Memory Ministry, a brand of Alokek Inc.
• Raw Files: Raw files are not included in standard packages

Liability and Indemnification

• Limitation of Liability: Our liability is limited to the amount paid for services
• Force Majeure: We are not liable for events beyond our control (weather, natural disasters, etc.)
• Client Indemnification: Clients indemnify us against claims arising from their use of images
• Equipment Damage: Clients are responsible for damage to our equipment caused by their actions
• Location Permissions: Clients are responsible for obtaining necessary location permissions
• Insurance: We carry professional liability insurance for our services

Privacy and Data Protection

Our privacy practices are detailed in our Privacy Policy. By using our services, you agree to:

• Data Collection: Allow collection of personal information necessary for service provision
• Photo Usage: Consent to use of your photographs as outlined in these Terms
• Communication: Receive communications related to your session and our services
• Data Retention: Understand our data retention policies as outlined in our Privacy Policy
• Third-Party Services: Accept use of third-party services for payment processing and delivery

Dispute Resolution

• Direct Communication: Attempt to resolve disputes through direct communication first
• Mediation: If direct resolution fails, parties agree to attempt mediation
• Legal Action: Legal action may only be pursued after mediation attempts
